Abstract: e right to part icipate in commercial shing and allocation of quotas
When discussing the rights of the Sami people in relation to the exist ing
Norwegian sheries management system and shery p olicy, knowledge of the
legal framework and regulat ions in force is necessary. is article g ives a sum-
mary of the Norwegian government’s view of the marine resource s as common
resources, a brief introduction to the legislation regardi ng participation in com-
mercial shery in Norway and the d istribution/allocation of quotas according to
the act relating to the management of wild liv ing marine resources. e article
ends with a discussion of the legal pos sibilities the change the established al-
location of quota s.

Når urfolksrettig heter skal diskuteres opp mot dagens forvaltningsordn inger og
skeripolitikk, k reves en viss kunns kap om gjeldende rett. I denne artik kelen
blir det gitt en oversikt over statens syn på ressursene som fellesressur ser og en
kort innføring i reglene om adgang ti l å delta i ervervsmessig ske og kvoteforde-
ling i medhold av havressursloven. Arti kkelen avsluttes med en diskusjon om det
rettslige handlingsrommet for å endre den etablerte fordelingen mellom ul ike
fartøygruppen. Formålet med ar tikkelen er derfor ikke å drøe u rfolksrett, men
å gi et bidrag til den bak grunnskunnskapen som bør foreligge.
